Orcon Genius Go Terms and Conditions

  1. Orcon Genius Go offers calling and text messaging services delivered via the Orcon Genius Go Application (“Genius Go App” or “App”) which is licensed to the end user (“you”). In order to download the App you must first accept these Terms of Use.
  2. Your agreement with Orcon is made of the terms and conditions set out in these Terms of Use together with any fair usage policies.  If you receive other Orcon services, the terms and conditions in relation to such services continue to apply to those services.
  3. Orcon reserves the right to make changes to these terms and conditions at any time and the changes will be effective when published at  
  4. Orcon reserves the right to amend or withdraw the App and any services associated with the App at any time and for any reason.
  5. The App is NOT intended to support calls to emergency services (eg 111 or other emergency service telephone numbers).  You acknowledge that you will need to use traditional mobile voice services or fixed line telephone services to make calls to emergency services.  You should not use the App to make calls to emergency services and Orcon will not be liable to you for any loss or damage you suffer or for any costs, expenses or charges you incur arising from any inability to access emergency services using the Genius Go App.  The App is not a replacement for your primary telephone service.
  6. Orcon cannot guarantee that the Genius Go App will function without disruptions, errors or delay. A number of factors may impact the quality of your communications on the App and you acknowledge that Orcon does not guarantee the availability or quality of your communications and use of the App.
  7. You may not use the App for any unlawful or prohibited purpose including but not limited to:
    • (a) interception or monitoring, damaging or modifying any communication which is not intended for you;
    • (b) using any type of virus, worm or any other codes or instructions that are designed to disturb, delete, damage or disassemble the App;
    • (c) sending unsolicited communications or any communication not permitted by law;
    • (d) exposing any third party to material which is offensive, indecent or objectionable in any way;
    • (e) using the App to cause or intend to cause embarrassment or distress to, or to threaten, defame, harass or invade the privacy of any third party; or
    • (f) using any material or content that is subject to any third party proprietary rights unless you have a license or permission from the owner to do so
  8. Orcon reserves the right (but shall have no obligation) to review content delivered via the App for the purpose of enforcing these Terms. Orcon may in its sole discretion block, prevent delivery of or otherwise remove the content of communications as part of its effort to protect the Genius Go App or its customers, or otherwise enforce these Terms. Further, Orcon may in its sole discretion remove such content and/or terminate your Orcon Genius Go account if you use any content that is in breach of these Terms.
  9. If you are an eligible Orcon home phone service customer you may link the Genius Go App to your Orcon home account.  You may add other App users who reside at your premises to your Orcon home account.  As the Orcon account holder, you will be responsible for all charges incurred on your Orcon account including all charges incurred by App users you have added to your account. You will also be responsible for the security and confidentiality of your Orcon password. Orcon will not be liable for any unauthorized use of your password and may charge a fee if you request an investigation of the use of your account.
  10. ’Call From My Home Phone’ calls from the App will be charged at the same rate as calls from your Orcon home phone , and will count towards any calling bundle you have purchased for your home phone account. Free Zone calls have no per minute charge associated with them.
  11. When you install the Genius Go App you will be asked to provide Orcon Limited with your phone number and to allow us access to your mobile device's address book ( “Contacts Information"). A copy of the phone numbers in your address book (but not names, email addresses, notes or any other personal information in your address book) will be stored on our servers and will only be used to:
    • (a) notify you when your contacts are online on Genius Go,
    • (b) indicate which of your contacts is already a Genius Go user,
    • (c) correctly display the name of each contact as it appears in your address book when a call is received.

    The phone numbers in your contact list are stored on a live database.
    Your phone number, which will be verified via a text message that will be sent to you, will be used for identification purposes as your Genius Go user ID.
  12. Should you uninstall the App at any time, any call records and any messaging records will be lost and will be irretrievable.
  13. You acknowledge that the terms of agreement with your mobile network provider (“Mobile Provider”) will continue to apply when using the Genius Go App. As a result, you may be charged by the Mobile Provider for data and access to network connection services for the duration of the connection while accessing the App or any such third party charges as may arise. You accept responsibility for any such charges that arise.
  14. If you are not the bill payer for the mobile telephone or handheld device being used to access the App, you will be assumed to have received permission from the bill payer for using the App.
  15. All trade marks, copyright, database rights and other intellectual property rights of any nature in the App together with the underlying software code are owned either directly by Orcon or by Orcon’s licensors.
  16. This App is available to handheld mobile devices running Apple iOS and Android OS Operating Systems.
  17. In no event will Orcon be liable for any direct, indirect, special, or consequential losses or damages of whatsoever kind arising out of your use or access to the Application, including loss of profit or the like, whether based on breach of contract, tort (including negligence), product liability or otherwise.
  18. Orcon is not liable to you for any damage or alteration to your equipment including but not limited to computer equipment, handheld device or mobile telephones as a result of the installation or use of the App.

Privacy Policy

  1. During the provision of services to you, you agree that Orcon may collect information about you. This may be obtained from you or may be generated from your use of the Orcon services. You may decide not to provide us with certain personal information but this may mean that we cannot provide the services to you. Orcon will deal with all your information in accordance with the Privacy Act 1993.
  2. We may monitor or record calls to customer services for training purposes, to improve service quality and to aid in dispute resolution.
  3. You can at any time make a written request to see any personal information that we hold or to ask us to correct any mistakes in that information.
  4. You agree that we can collect information about you (such as your home address, phone number and evidence that you will be able to pay for our services) and the ways that you use our services. We will collect this information from our communications with you and through your use of the services. You agree that we can use this information and can pass it on to our employees, contractors, agents and suppliers for a range of lawful purposes connected with our business operations, including, but not limited to:
    • complete credit checking
    • providing services to you
    • administering your account
    • recovering overdue accounts
    • keeping you informed about our services (unless you have advised us that you do not want to receive this information). You agree that we may send you marketing messages, electronic or otherwise, about our special offers, products and services which may be of interest to you. You agree too that the electronic marketing message we send you need not include an unsubscribe facility
    • looking at ways in which we can improve our services
    • sending you bills
    • resolving any disputes
    • training our staff
  5. If you contact us through the preferred contact email address you register with us when you create your account, we will take this to mean you are the account holder and have authority on the account. Please keep access to your preferred email account secure.
  6. Cookies
    When you visit Orcon, we may send you a cookie. A cookie is a small file which is placed on your computer or device.
    6.1 Functional Cookies
    These are used to remember your preferences with Orcon. This can be anything from remembering your username to your favourite data pack so you don’t have to pick it all the time.
    6.2 Analytical Performance Cookies
    In short, they allow us to improve your online experience by understanding how the website is performing. Things like optimising My Account so you can quickly do what you need to do and identify areas that need maintenance.
    6.3. Advertising Cookies
    We use these cookies to help place relevant ads on third party sites based on your prior visits to this website.
